This Privacy Policy applies to the website miamionlyone.com operated by MKS US Real Estate LLC, a limited-liability company registered in the State of Florida, USA (document no. L23000501822; EIN 36-5089244), with its registered office at 1200 Brickell Avenue, Suite 1960, Miami, FL 33131. We are committed to protecting your personal information in accordance with applicable US federal and state law, including the California Consumer Privacy Act as amended by the California Privacy Rights Act (CCPA/CPRA), and, for visitors residing in the European Union or the United Kingdom, the General Data Protection Regulation (GDPR) and the UK GDPR. By using this site you acknowledge this Privacy Policy.
1. Information We Collect
Information you provide directly. When you submit a booking inquiry, contact form or restaurant/venue inquiry, we collect the data you supply: your first and last name, email address, phone number, travel dates, number of guests, any message you include, and (when applicable) your preference for optional add-ons (late checkout, airport transfer).
Payment information. All payment transactions are processed exclusively by our payment provider, Stripe, Inc. We do not store, transmit or have access to your full credit- or debit-card number, CVV or expiry date. Stripe provides us with a transaction reference and the last four digits of your card solely for booking-management purposes. Stripe's own privacy policy applies to payment data.
Technical and usage data. Our hosting and form provider (Netlify) and our analytics tool (Google Analytics 4) may automatically record data such as your IP address, browser type, device type, operating system, referring URL, pages visited and time spent on each page. This data is used in aggregate form to improve site performance and is not used to identify you individually.
Communications. If you contact us by email or WhatsApp, we retain the content of those communications to respond to and follow up on your request.
2. How We Use Your Information and Legal Basis
We use the information we collect for the following purposes:
- To respond to your inquiry and confirm availability and rates.
- To manage your reservation, process your deposit and balance payment, and coordinate your arrival.
- To send you booking confirmations, pre-arrival information and post-stay follow-up.
- To improve our website using aggregate, anonymised analytics.
- To comply with our legal, tax and accounting obligations under applicable law.
For visitors in the European Union or the United Kingdom, our legal bases under the GDPR are: (a) steps taken at your request prior to entering a contract and the performance of that contract (reservation management and payment); (b) our legitimate interest in operating and improving the residence and this website; and (c) your consent, where specifically requested (e.g., analytics cookies for EU visitors). Where we rely on consent, you may withdraw it at any time without affecting the lawfulness of prior processing.
3. Cookies and Analytics
Functional cookies. This site uses session cookies that are strictly necessary for navigation and security. These cookies do not collect personal data, are temporary, and cannot be disabled without affecting core site functionality.
Analytics cookies (Google Analytics 4). We use GA4 to understand how visitors interact with our site. For visitors in the European Union or UK, analytics cookies are loaded only after you give explicit consent via the cookie banner. For visitors outside the EU/UK, GA4 is loaded by default and you may decline via the cookie banner. GA4 uses anonymised IP addresses and does not allow us to identify you personally. No advertising, retargeting or social-media tracking cookies are used on this site.
Calendar (Flatpickr). The date-picker widget operates entirely in your browser and collects no personal data from you.
Your choices. You may withdraw or change your analytics consent at any time by clicking the cookie icon in the footer, or by clearing your browser cookies. Withdrawing consent does not affect the lawfulness of any prior processing.
4. How We Share Your Information
We share your personal information only with the service providers necessary to operate our business:
- Netlify, Inc.:website hosting and form submission storage (United States).
- Stripe, Inc.:payment processing (United States).
- Resend, Inc.:transactional email notifications for bookings (United States).
- Google LLC:website analytics via GA4, subject to your consent where required.
Each provider is contractually bound to process your data only as instructed and to apply appropriate security measures. We may also disclose your information to professional advisers (lawyers, accountants) and to competent authorities when required by law, regulation or legal process. We do not sell, rent or share your personal information with third parties for their own marketing purposes (as defined by the CCPA/CPRA). We do not engage in cross-context behavioural advertising.
5. Data Retention
We retain booking and reservation data for the period required by Florida law and applicable accounting rules, generally five (5) years from the date of the stay. Inquiry data that does not result in a booking is retained for up to twelve (12) months. Technical server logs are retained for 30 to 90 days. Once the applicable retention period expires, your data is deleted or irreversibly anonymised. You may request earlier deletion subject to our legal-retention obligations (see Section 6 below).
6. Your Rights
Rights under the GDPR (EU/UK residents). You have the right to: (a) access a copy of the personal data we hold about you; (b) have inaccurate data corrected; (c) request erasure of your data where no legal basis remains for its retention; (d) restrict processing in certain circumstances; (e) receive your data in a portable, machine-readable format; (f) object to processing carried out on the basis of our legitimate interest; and (g) withdraw consent at any time. You also have the right to lodge a complaint with your local supervisory authority (in France: the CNIL; in the UK: the ICO).
Rights under CCPA/CPRA (California residents). You have the right to: (a) know what personal information we collect, use, disclose or sell about you; (b) request deletion of your personal information, subject to certain exceptions; (c) correct inaccurate personal information; (d) opt out of any sale or sharing of your personal information (we do not sell or share); and (e) not be discriminated against for exercising any of the above rights.

7. International Data Transfers
We are based in the United States, and your personal data is processed and stored on servers located in the United States. If you are visiting from the European Union or the United Kingdom, this constitutes a transfer of personal data to a third country. We rely on the appropriate legal mechanisms for such transfers, including standard contractual clauses where applicable, and on the legitimate bases identified in Section 2 above. Our service providers (Netlify, Stripe, Resend, Google) each maintain their own data-transfer compliance programmes.
8. Children and Minors
This site is intended for users aged 18 and over. We do not knowingly collect or solicit personal information from anyone under the age of 16. If we become aware that we have inadvertently collected data from a minor, we will delete it promptly. 9. Third-Party Links
This site may contain links to third-party websites (e.g., restaurant official pages, Google Maps). We are not responsible for the privacy practices of those websites and encourage you to read their privacy policies before providing any personal information.
10. Security and Contact
We implement reasonable technical and organisational security measures to protect your personal information against unauthorised access, disclosure, alteration or destruction. These include SSL/TLS encryption for all data in transit, access controls, and contractual security obligations with our service providers. No method of transmission over the Internet is 100% secure; we cannot guarantee absolute security.
