
Terms and Booking Conditions
Please read these terms carefully. By completing your reservation you agree to be bound by them.

These Terms and Booking Conditions ("Terms") govern all reservations made through miamionlyone.com, operated by MKS US Real Estate LLC, a Florida limited liability company (document no. L23000501822; EIN 36-5089244), 1200 Brickell Avenue, Suite 1960, Miami, FL 33131, USA (the "Operator"). The property is a private residence located at 2341 Collins Avenue, Unit 1440, Miami Beach, FL 33139 (the "Residence") within the 1 Hotel & Homes South Beach resort. Miami Only One is an independently managed private residence. This website is not the official website of 1 Hotel South Beach.
1. Booking and Confirmation
A reservation is created when you submit the booking form on this site and your 30% deposit payment is successfully captured by our payment provider (Stripe). Upon successful payment, your booking is instantly confirmed. A written confirmation is sent to your email address; your dedicated contact will follow up within 24 hours to finalise arrival logistics. The confirmation email, together with these Terms, constitutes the entire agreement between you and the Operator.
Our system verifies availability and recalculates your total price server-side before your Stripe Checkout session is created. You will see a full itemised breakdown, nightly rate(s), cleaning fee, resort fee and taxes, before any payment is captured.
Reservations are subject to availability. The Operator reserves the right to cancel any reservation made in error or that contains inaccurate guest information, with a full refund of any amounts paid.
2. Rates, Fees and Taxes
Nightly rates vary by season and are displayed in US dollars. All prices are quoted per night for the Residence as a whole.
Mandatory fees added to every stay:
- Cleaning fee: $250 (one-time, per stay).
- Resort fee: charged per the 1 Hotel South Beach schedule applicable at the time of booking. This fee covers access to resort amenities and is subject to change by the resort.
- Florida and Miami-Dade County taxes: currently approximately 13% of the subtotal, comprising Florida state sales tax, Miami Beach resort tax and the county community development district tax.
Optional add-ons available at booking: late check-out (subject to availability, $150); airport or inter-Miami transfer ($200 per trip). These are non-refundable once confirmed.
The total amount due, including all fees and taxes, is displayed in your Stripe Checkout session before any payment is captured. No hidden charges are applied after confirmation.
3. Deposit and Balance Payment
A deposit of 30% of the total stay amount (including fees and taxes) is due at the time of booking and is charged immediately via Stripe upon confirmation.
The remaining balance of 70% is due no later than 30 calendar days before your scheduled arrival date. For bookings made within 30 days of arrival, the full amount (100%) is charged at the time of booking.
All payments are processed securely by Stripe. The Operator accepts Visa and Mastercard. Payments are non-refundable except as expressly set out in the Cancellation section below.
If the balance is not received by the due date, the Operator reserves the right to cancel the reservation and retain the deposit, having first provided written notice and a 48-hour opportunity to cure.
4. Cancellation and Refunds
All cancellations must be notified in writing to hello@miamionlyone.com. The cancellation date is the date the Operator receives the written notification.
- Cancellation 30 or more calendar days before arrival: full refund of all amounts paid.
- Cancellation between 30 and 14 calendar days before arrival: 50% of the total stay amount is refunded; the remaining 50% is forfeited.
- Cancellation within 14 calendar days of arrival, no-shows, or early departure: no refund is due for any portion of the stay.
The specific cancellation terms set out in your written confirmation prevail over this summary in the event of any discrepancy.
The Operator strongly recommends that all guests purchase comprehensive trip-cancellation insurance to protect against unforeseen circumstances. The Operator does not endorse any specific insurer.
In the event the Operator must cancel a confirmed reservation for reasons within its control (e.g., property damage making the Residence uninhabitable), a full refund of all amounts paid will be issued within 7 calendar days and the Operator will make reasonable efforts to assist in finding alternative accommodation.
5. Check-In and Check-Out
Check-in is available from 4:00 p.m. on your arrival date. Please notify the Operator of your estimated arrival time at least 24 hours in advance. A Miami Only One representative will coordinate your check-in with the 1 Hotel South Beach residential front desk. A valid government-issued photo ID is required from the primary guest at check-in.
Check-out is at or before 11:00 a.m. on your departure date. Guests who remain in the Residence after 11:00 a.m. without the Operator's prior express written authorisation will be charged the equivalent of one full night's rate at the applicable seasonal price, prorated per day for each day of unauthorised holdover.
Late check-out (until 2:00 p.m.) may be arranged in advance for an additional fee of $150, subject to availability. It cannot be guaranteed and is not available on the final day of peak-season periods.
6. Occupancy and Guest Conduct
The Residence accommodates a maximum of 6 guests across three bedrooms. Exceeding the maximum occupancy is a material breach of these Terms and may result in immediate termination of the stay without refund.
The minimum stay is 2 nights.
All guests and invitees must comply with the following rules at all times:
- No smoking of any kind (including electronic cigarettes and vaping devices) inside the Residence or on the private balcony.
- No parties, events or gatherings beyond the registered guests without the Operator's prior written consent. Requests for larger gatherings must be submitted at least 72 hours in advance; additional charges may apply.
- No outside catering or amplified music without the Operator's prior written consent.
- Noise must be kept at a level that does not disturb other residents. Florida law and 1 Hotel house rules on noise apply at all times.
- Sand must be rinsed from feet and body before re-entering the Residence.
- No bleaching or dyeing of hair inside the Residence.
- The primary guest is responsible for the conduct of all members of their party and any invitees.
The Operator reserves the right to terminate a stay immediately, without refund, if guests engage in unlawful activities, materially breach these Terms, or cause disturbance to other residents of the building.
7. Condition of the Residence
The Residence will be presented in a clean and well-maintained condition at check-in. Guests agree to return the Residence in substantially the same condition at check-out, normal wear and tear excepted.
Guests are responsible for any and all damage to the Residence, its furnishings, appliances and fixtures caused by themselves, members of their party or any invitees. This includes but is not limited to stained soft furnishings or flooring, broken items and damage resulting from prohibited activities.
The Operator or its authorised agents may enter the Residence at reasonable times and with advance notice to carry out repairs, maintenance or housekeeping. In the event of an emergency, the Operator may enter without notice.
Guests must promptly notify the Operator of any damage or maintenance issue discovered during the stay by contacting hello@miamionlyone.com or +33 6 50 92 81 34. Do not contact the 1 Hotel residential front desk directly for maintenance issues relating to the Residence.
8. Security Deposit
A credit card authorisation (hold) may be required at check-in as a security deposit. The amount will be communicated in your confirmation. No funds will be charged against this hold unless damage or additional charges are identified during the post-check-out inspection.
The Operator will conduct an inspection of the Residence before and after each stay. If damage or additional cleaning is required beyond normal wear and tear, the Operator will provide a written statement of deductions within 7 calendar days of your check-out date, and the authorised amount will be charged to the card on file. If damage costs exceed the security hold, the guest is liable for the full excess amount and authorises the Operator to charge the card on file accordingly.
9. Pet Policy
The Residence is located within a property that permits small pets subject to 1 Hotel South Beach's own pet policy. Guests wishing to bring a pet must request and receive written authorisation from the Operator prior to arrival. Guests must also complete the pet registration form required by 1 Hotel South Beach at the residential front desk before check-in.
Guests who bring a pet without the Operator's prior written authorisation will be charged a penalty of between $500 and $1,500, in addition to the full cost of any damage caused by the pet.
Guests are solely responsible for their pet at all times and for any damage, injury or disturbance caused by the pet. All applicable resort rules regarding pets must be observed.
10. Housekeeping and Toiletries
An initial clean of the Residence is included in the mandatory cleaning fee paid at booking. Daily maid service is not included and may be arranged for an additional fee; rates will be provided on request.
Housekeeping takes place between 10:00 a.m. and 5:00 p.m. The cleaning team holds a key and does not require guests to be present. Guests are asked to secure any valuables in the provided safe before leaving the Residence on cleaning days.
Only the Operator's own cleaning staff may carry out housekeeping in the Residence. Guests may not bring or hire outside cleaning personnel.
Complimentary toiletries are provided in each bathroom. These items are for in-residence use only and may not be removed. A replacement fee of $35 per missing item will be charged.
11. Resort Amenities
As a guest of the Residence, you have full access to all open resort amenities at 1 Hotel South Beach, including the private beachfront, four pools (including the rooftop pool), fitness centre and resort grounds. Spa treatments, restaurant dining and other à-la-carte services are available at additional cost directly through the resort.
The Operator is not responsible for the availability, quality or operation of resort amenities, which are managed exclusively by 1 Hotel South Beach. Any concerns about resort facilities should be directed to the resort concierge.
Guests use all resort amenities, including beach, pool, spa and fitness areas, entirely at their own risk. The Operator and the Residence owner are not liable for any injury, illness or loss sustained while using resort amenities.
12. Booking Modifications
Any change to a confirmed reservation (including date changes, addition of guests or add-ons) is subject to availability and must be approved in writing by the Operator. An administrative fee of $100 applies to each booking modification after a confirmation has been issued. Rate differences resulting from date changes will be charged or refunded at the applicable seasonal rate.
13. Extended Absence
Guests who plan to be absent from the Residence for five (5) consecutive days or more during their stay must notify the Operator in advance. Failure to provide such notice may result in the guest being held liable for any damage that occurs as a result of or during the unnotified absence.
14. Abandonment of Personal Property
Any personal property left in the Residence after check-out will be held by the Operator for a period of 20 calendar days. The Operator will attempt to notify the guest by phone, email and/or mail. If the guest does not respond within 20 days, the Operator may dispose of, donate or arrange for the sale of the property without further liability to the guest.
15. Limitation of Liability and Indemnification
To the maximum extent permitted by applicable law, the Operator's total liability to any guest for any claim arising out of or relating to a reservation or stay, including but not limited to property damage, personal injury or loss of enjoyment, shall not exceed the total amount paid by the guest for the stay in question.
The Operator is not liable for: (a) theft or loss of personal property; (b) damage to personal property; (c) personal injury occurring outside the Residence or during use of resort amenities; (d) any failure of resort amenities, utilities or third-party services; or (e) events beyond the Operator's reasonable control (see Force Majeure below).
By making a reservation, guests agree to indemnify, defend and hold harmless the Operator, its members, managers, employees and agents from and against any and all claims, losses, damages, liabilities and expenses (including reasonable legal fees) arising from: (a) any breach of these Terms by the guest or any member of their party; (b) any damage to the Residence caused by the guest or their invitees; or (c) any injury or loss suffered by a third party as a result of the guest's actions or omissions during the stay.
16. Force Majeure
Neither party shall be in breach of these Terms or liable for any failure or delay in performance caused by circumstances beyond their reasonable control, including but not limited to acts of God, hurricane, flood, fire, pandemic, governmental action, war or civil unrest, or failure of essential utilities. If a force-majeure event prevents the Operator from making the Residence available, any amounts paid for the affected period will be refunded within 14 calendar days.
17. Dispute Resolution and Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Florida, USA, without giving effect to any conflict-of-law principles. Any dispute, claim or controversy arising out of or relating to these Terms or a reservation shall first be submitted in good faith to mediation. If mediation fails, the dispute shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, with the seat of arbitration in Miami-Dade County, Florida. Each party shall bear its own costs unless the arbitrator awards otherwise. Nothing in this clause prevents either party from seeking urgent injunctive relief from a court of competent jurisdiction.
By making a reservation you expressly waive any right to a trial by jury or to participate in any class or representative action.
